Deciding to place your loved one in a nursing home for the care they need can be hard. What can be even more difficult is learning that they suffered abuse from the staff at the facility. If an elder in your life was harmed because of a caregiver’s reckless actions or negligence, you might be entitled to a claim against the abuser to recover compensation for damages such as medical bills and emotional distress. Prevalence of Nursing Home Abuse
In June of 2019, a report issued by Senators Bob Casey, D-Pa. and Pat Toomey, R-Pa. showed that nearly 400 U.S. nursing homes were cited by the Centers for Medicare and Medicaid Services for lack of proper care. There were various reasons for the citations. Some facilities did not adequately administer medication, which led to worsening health conditions and even death. Others had insect infestations, and bugs were found crawling on residents and countertops. Although legislators and families have called for increased oversight and stricter regulations, mistreatment still occurs at nursing homes.
Nursing home abuse can occur for many reasons, including poor training, understaffing, and inexperienced hires.
Maltreatment can take many forms, including:
- Physical abuse
- Mental abuse
- Financial abuse
- Sexual abuse
Often, the injury is not reported because the senior is unable to communicate or too embarrassed about what they were subjected to do so. If your loved one is showing signs of maltreatment or neglect, report it to authorities immediately and remove the resident from the facility to prevent further issues.
