McCune Wright Arevalo, LLP has filed employee class action lawsuits against McDonalds, Jimmy John’s, Burger King, Little Caesar’s and Domino’s resulting from these fast food franchises agreement not to allow employees to transfer from one independent franchise to another independent franchise without the agreement of both franchises to the transfer. These agreements are called “no-poach” agreements. The limiting of the employee’s ability to transfer removes employee compensation competition and operates to limit employee wages. The complaints allege that this action is an antitrust violation.
