Toyota Hybrid Brake Defect Lawsuits

In June 2014, alleged failed brakes on a 2013 Toyota Prius Liftback allegedly led a driver to plow into three teenage girls in a North Hollywood crosswalk.

Now, a Southern California Toyota car dealer is calling for the recall of certain Toyota vehicles and the National Highway Traffic Safety Administration (NHTSA) is looking into a series of possible brake failures.

  • 2012-2014 Camry Hybrid
  • 2013-2015 Avalon Hybrid

Defective Brake Booster Pump Assemblies

The allegedly malfunctioning part is the “brake booster pump assembly with master cylinder.” Toyota currently refuses to replace the defective component until the vehicle exhibits a brake system warning light and registers one of four specific Diagnostic Trouble Codes. In an interview, the president of Claremont Toyota and Capistrano Toyota, who petitioned for investigation, said:

We want [Toyota] to fix the brakes before there’s a failure putting lives at stake.”

Unfortunately, the NHTSA has received more than 115 complaints since 2010. Sixty of these reports involved collisions. According to the defect petition:

This brake defect is causing crashes that are injuring people – and Toyota is mishandling it.”

Petition Under Review

The petition for a safety recall is under review by the NHTSA as of January 3, 2020. If NHTSA officials decide to launch a formal investigation, it could take approximately one year for any recall to commence. In the meantime, Toyota has issued at least two voluntary safety recalls regarding the brake systems of its hybrid vehicles, but continues to exclude many years and models with defective braking components.

Victims of Toyota’s alleged oversight, like the teenager who suffered permanent brain damage in North Hollywood, however, have already been harmed.

As the petition states:

Toyota has put innocent lives at risk by knowingly excluding hundreds of thousands of hybrids with defective brakes from past safety recall populations . . . . The National Highway Safety Administration should immediately investigate this safety defect and prevent additional injuries and potential deaths.”
