McCuneWright, LLP has filed national class action lawsuits against General Motors, LLC, and Hyundai Motor America, alleging pervasive false advertising to consumers relating to the miles per gallon (MPG) estimates these auto manufacturers are using in their sales campaigns.
The lawsuits against General Motors and Hyundai claim that customers make purchase decisions based greatly on the MPG information that was provided by these manufacturers, their dealers and salespersons. The real world MPG that these General Motors and Hyundai owners were getting proved to be substantially less than the brochures, advertisements, and claims by salespersons.
In addition, to the incorrect and misleading MPG information, there was specific representation of total miles that consumers could expect on a full tank of gas. Actual distance that specific GM vehicles traveled on a full tank of gas was significantly less than the advertised and promised range.
In the filed complaints against General Motors and Hyundai, McCuneWright, alleges the auto manufacturers failed to provide required notice that the MPG estimates given were EPA estimates based on laboratory testing, that do not reflect the actual miles per gallon achieved in real world driving conditions.
