DePuy Hip Replacement Recall

The Problem

On August 24, 2010, DePuy Orthopaedics, Inc., announced the recall of 93,000 implanted artificial hips as a result of field studies in England showing that these artificial hips had a high rate of failure in patients. Further information has, and continues, to surface showing before the recall, DePuy had knowledge of the problems with these artificial hips, yet failed to warn doctors and patients of the problem.

The failure of these defective artificial hips has resulted in pain, difficulty in walking, the need for revision surgery, and progressive soft tissue reaction in many patients, as well as the need for medical monitoring for all patients.

What should you do first?

The first thing you should do if you have had a hip replacement surgery since 2003 and do not know the manufacturer of artificial hip, is to call your doctor's office and find out if have one of the recalled DePuy artificial hips. Your doctor has that information in your medical chart. If you do have one of the recalled DePuy hips, you should see your doctor to determine if there are any problems with the hip implant.

Do You Need Legal Representation If You Have One of the Recalled DePuy Hips?

If you are experiencing hip problems caused by a DePuy recalled hip, or you have had revision surgery, then you will need legal representation. The reason is that while DePuy has agreed to pay for certain medical costs associated with medical monitoring, testing, and revision surgery, they impose an important condition on that promise – that you must first establish your problems were caused by a defect in the hip. It is common for manufacturers of failed hip implants to try and escape liability by blaming the surgeon for improperly implanting the hip or blaming the patient for doing something to damage the artificial hip.

The other reason why you need legal representation is that DePuy has not agreed to pay damages for the pain, suffering, and anxiety these failed hips cause, and you will need legal representation to recover full value for your damages.

If you are not experiencing problems and your doctor tells you that your hip is working properly, a lawyer can advise you of your rights if you have problems in the future.
